1. DEFINITIONS

For purposes of this Agreement:

“Lion Constructed,” “we,” “us,” or “our” refers to Lion Constructed.

“Client,” “you,” “your,” “they,” or “them” refers to the individual or individuals purchasing the shed and, where applicable, the property owner or other individual on whose property the shed will be located.

Estimate

“Estimate” means the written document provided by Lion Constructed by email, mail, or another agreed method that describes the proposed shed, specifications, options, pricing, and other project details.

The Estimate will generally identify the Client by name. If more than one Estimate is issued because of changes, updates, or revisions, the most recent Estimate signed or otherwise approved by the Client will control and replace previous Estimates for the items that were changed.

2. SHED SERIES & PROJECT SPECIFICATIONS

Lion Constructed currently offers two standard shed series:

  • Strong Series

  • Bold Series

Pricing, specifications, and available options may vary between the two series.

The shed series, size, configuration, options, and price selected by the Client will be identified in the applicable Estimate.

Nominal Dimensions

All dimensions quoted by Lion Constructed are nominal dimensions unless specifically stated otherwise.

Minor variations may occur as a normal part of the construction process, including slight differences in:

  • Wall height

  • Door width

  • Window placement

  • Trim dimensions

  • Framing dimensions

  • Roof dimensions

  • Expansion and installation gaps

  • Other measurements

These minor variations do not constitute a defect when the completed structure remains substantially consistent with the agreed specifications.

3. STRONG SERIES SHED

Unless otherwise stated in the applicable Estimate, the Strong Series includes:

  • TuffBlock footings

  • 2x6 or larger pressure-treated floor joists, 16" on center

  • LP Legacy subfloor sheathing

  • 2x4 wall studs, 24" on center

  • LP SmartSide sheathing

  • Architectural shingles with a 30-year manufacturer warranty

  • Roof drip edge

  • White PVC trim

  • Locking double-door handle with key

  • Gable vents

  • One approximately 18" x 27" single-pane shed-style window

Specific materials or products may be substituted with comparable materials when necessary because of availability, manufacturer changes, or other circumstances, provided the substituted materials are reasonably comparable in quality and intended use.

4. BOLD SERIES SHED

Unless otherwise stated in the applicable Estimate, the Bold Series includes:

  • TuffBlock footings

  • 2x6 or larger pressure-treated floor joists, 16" on center

  • LP Legacy subfloor sheathing

  • 2x4 wall studs, 16" on center

  • Double top plate

  • LP SmartSide sheathing

  • Architectural shingles with a 30-year manufacturer warranty

  • Roof underlayment

  • Roof drip edge

  • White PVC trim

  • Locking double-door handle with key

  • Gable vents

  • One approximately 18" x 27" single-pane shed-style window

Specific materials or products may be substituted with comparable materials when necessary because of availability, manufacturer changes, or other circumstances, provided the substituted materials are reasonably comparable in quality and intended use.

5. OPTIONAL ADD-ONS

Lion Constructed offers a variety of optional upgrades and additions that may be available for either shed series.

Examples include:

  • Benches

  • Lofts

  • Ramps

  • Additional windows

  • Additional doors

  • Shelving

  • Other available upgrades

All optional additions must be selected, priced, and included in the applicable Estimate before construction begins. Options generally cannot be added on the day of construction because materials, labor, and scheduling may already have been arranged. Any requested addition after the project has entered the preparation or construction phase is subject to availability and Lion Constructed's approval.

Additional charges may apply.

6. LICENSING, PERMITS & SITE REQUIREMENTS

Lion Constructed maintains the applicable insurance and business registrations required for the work it performs.

Client Responsibilities

Where applicable, the Client is responsible for obtaining and complying with:

  • Building permits required for the project

  • HOA approvals

  • Property-owner approvals

  • Zoning requirements

  • Setback requirements

  • Utility or power-line setbacks

  • Property restrictions

  • Other permits or approvals that are the Client's responsibility

The Client must notify Lion Constructed of any applicable permit requirements, restrictions, or approvals at least one (1) week before the scheduled build date. If the Client has already obtained a permit or approval, the Client must provide Lion Constructed with the applicable information or documentation at least one week before construction whenever reasonably possible. Lion Constructed is responsible for complying with building-code requirements applicable to the structure and work performed by Lion Constructed.

7. ACCESS TO THE BUILD SITE

The Client must provide a reasonably clear path to the construction area.

Unless otherwise agreed, the Client should provide a path of at least four (4) feet in width from the access point to the shed location. The path should remain clear throughout construction.

If a four-foot path cannot be provided, the Client must notify Lion Constructed before the scheduled build date so that the situation can be evaluated and appropriate accommodations can be discussed.

8. SPECIAL REQUESTS & SPECIAL-ORDER ITEMS

Special requests outside Lion Constructed's standard sheds and available options may require additional materials, labor, preparation, and/or deposit funds.

Examples may include:

  • Exterior doors

  • Garage doors

  • Specialty windows

  • Custom hardware

  • Non-standard building materials

  • Other non-stock items

Additional funds may be required before Lion Constructed orders these items.

Cancellation of Special-Order Items

If the Client cancels the project after a special-order or non-stock item has already been ordered or purchased specifically for the project, the amount paid toward that item may be non-refundable to the extent permitted by applicable law.

If Lion Constructed is able to return the item and receive a refund from the manufacturer or supplier, Lion Constructed will refund the amount actually recovered, less:

  • Any manufacturer or supplier restocking fee; and

  • A 15% handling fee charged by Lion Constructed.

Any applicable refund will not be issued until Lion Constructed has actually received the refund from the manufacturer or supplier.

9. PRE-BUILD COMMUNICATION

Lion Constructed primarily communicates with Clients by:

  • Email

  • Text message

  • Telephone

The scheduled build date will be identified in the applicable Estimate or written confirmation.

Build dates are subject to change because of weather, materials, scheduling, illness, equipment issues, transportation issues, or other circumstances outside Lion Constructed's reasonable control.

Lion Constructed will provide as much notice as reasonably possible when a scheduled date needs to change.

10. FINAL PRE-BUILD CONFIRMATION

Before construction begins, Lion Constructed may send the Client a final confirmation containing:

  • Shed specifications

  • Layout

  • Options

  • Pricing

  • Construction details

  • Other applicable project information

Lion Constructed requires the Client's confirmation before proceeding with construction preparation or construction.

24-Hour Change Period

The Client may request changes to the final confirmation within 24 hours of receiving it.

If a change is requested, Lion Constructed may issue a revised Estimate or confirmation reflecting the requested change and any applicable price adjustment.

A new 24-hour review period may apply to the revised confirmation.

After the applicable 24-hour period, changes may still be requested; however, Lion Constructed is not obligated to accommodate changes if construction preparation, material purchases, special-order purchases, or other project work has already begun.

Any costs already incurred for special-order materials, pre-build preparation, or other project-specific expenses may not be refundable, subject to applicable law.

11. EARLIER BUILD DATES

If an earlier construction date becomes available, Lion Constructed may offer that date to the Client.

The Client may accept or decline the earlier date.

12. CUSTOMER PREPARATION BEFORE CONSTRUCTION

Before the scheduled build date, the Client should:

Pet Waste

Remove pet waste from the shed construction area and, where applicable, the access path to the construction area. This should be completed before the day of construction.

Parking

Provide reasonable parking/access for a pickup truck and trailer. The required space may be approximately 30 feet in length, depending on the project and access conditions. If adequate parking or access is not available, the Client must notify Lion Constructed before the scheduled build date.

13. SITE GRADE

Sheds installed on significantly sloped or uneven ground may require additional materials and labor.

Where the site grade requires additional work beyond standard installation, an additional charge may apply. If Lion Constructed determines before construction that additional materials or labor are required because of site conditions, Lion Constructed will communicate the additional charge to the Client before beginning the affected work.

14. TRAVEL CHARGE

A travel charge may apply to locations that are more than approximately 30 minutes of driving time one way from Morristown, Tennessee.

If a travel charge applies, Lion Constructed will notify the Client before making the trip whenever reasonably possible.

The applicable charge will be communicated to the Client before the additional travel expense is incurred.

15. INSTALLATION DATE

Lion Constructed's crew will generally arrive within approximately one hour of the scheduled arrival time.

If a significant delay is anticipated, Lion Constructed will notify the Client when reasonably possible.

Before construction begins, Lion Constructed will confirm the:

  • Shed placement

  • Orientation

  • General layout

  • Access considerations

Lion Constructed prefers to confirm placement with the Client or an authorized representative who is physically present at the property. Once construction begins, changes to the placement or layout may not be possible without additional cost or delay.

16. CONSTRUCTION TIME

Most standard sheds are completed within approximately one (1) to three (3) days.

Some projects may require additional time because of:

  • Size

  • Options

  • Site conditions

  • Weather

  • Material availability

  • Special requests

  • Other project-specific circumstances

If Lion Constructed reasonably expects a project to require substantially more time than anticipated, we will communicate this to the Client.

17. WEATHER & SCHEDULE CHANGES

Construction dates are weather-dependent.

Lion Constructed may postpone or reschedule construction when weather or site conditions make construction unsafe or impractical.

Examples may include:

  • Heavy rain

  • Snow or ice

  • High winds

  • Saturated ground

  • Unsafe driving conditions

  • Extreme temperatures

  • Other hazardous conditions

Lion Constructed will make reasonable efforts to provide notice and establish a replacement construction date.

18. COMPLETION & FINAL ACCEPTANCE

Upon substantial completion, the Client will have an opportunity to perform a final walk-through of the shed. The Client should identify any visible concerns or punch-list items during the walk-through.

The Client's final payment is due according to the payment terms contained in the Agreement when the shed is substantially complete and ready for its intended use.

Minor Cosmetic Items

Minor cosmetic imperfections that do not materially affect the structure's intended use may occur as part of normal construction.

Examples may include:

  • Slight variations in nail placement

  • Minor differences in expansion gaps

  • Minor trim variations

  • Minor cosmetic imperfections

  • Other small variations inherent to construction

These minor variations do not automatically constitute a defect

.

Final Payment & Punch-List Items

The Client may not withhold the entire remaining contract balance because of minor cosmetic or non-structural items. If a legitimate minor punch-list issue remains after substantial completion, the Client's payment obligation remains subject to the payment terms of the Agreement and applicable law.

Any disputed withholding of payment must comply with applicable Tennessee law and the parties' written agreement. Lion Constructed will make reasonable efforts to address legitimate workmanship concerns within a reasonable period. Nothing in this section limits the Client's rights under the applicable workmanship warranty or rights that cannot legally be waived.

19. CUSTOMER RESPONSIBILITY AFTER COMPLETION

Following completion, the Client is responsible for completing any post-construction work identified in the Agreement as the Client's responsibility.

This may include:

  • Exterior caulking

  • Painting

  • Staining

  • Sealing

  • Routine maintenance

  • Other required finishing work

Failure to properly perform required post-construction maintenance may affect warranty coverage where the resulting damage is caused or contributed to by that failure.

20. AGREEMENT WITH ESTIMATE

The applicable Estimate, this Agreement, and any approved written change orders together establish the agreed scope of work for the project. If a conflict exists between a previous Estimate and a later signed or approved Estimate, the most recent signed or approved Estimate controls for the items addressed by the revision. No verbal representation or modification changes the agreed scope, price, or specifications unless confirmed in writing.
